Welcome to PromptGen ("we," "us," or "our"). By accessing or using our website at promptgen-ai.com, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using our service.

1. Acceptance of Terms

By creating an account or using any part of PromptGen, you confirm that you are at least 13 years old and agree to these Terms. If you are using the service on behalf of an organization, you represent that you have the authority to bind that organization.

2. Description of Service

PromptGen is an AI-powered image-to-prompt generation service. Users may upload images and receive structured prompts suitable for use with AI image generation tools. We offer the following plans:

Free Plan: 1 analysis per day at no charge.
Pro Plan: 1,000 credits per purchase (paid).
Enterprise Plan: 4,000 credits per purchase (paid).

Credits are consumed per image analysis. Unused credits do not expire unless otherwise stated.

3. User Accounts

You must sign in via Google OAuth to access features beyond the free tier. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. Notify us immediately of any unauthorized use.

4. Acceptable Use

You agree not to use PromptGen to:

Upload images that are illegal, harmful, abusive, defamatory, or infringe on any third party's rights.
Upload explicit sexual, violent, or otherwise prohibited content.
Attempt to reverse-engineer, scrape, or otherwise misuse our API or AI models.
Circumvent or abuse our credit or rate-limiting systems.
Use the service for any unlawful purpose.

We reserve the right to suspend or terminate accounts that violate these terms.

5. Intellectual Property

You retain ownership of any images you upload. By uploading content, you grant us a limited, non-exclusive license to process that content solely for the purpose of providing the service to you. Generated prompts are provided to you for your personal or commercial use.

The PromptGen name, logo, website design, and underlying technology are our intellectual property and may not be copied or reused without written permission.

6. Payments and Credits

Paid plans are processed through Paddle, our payment processor. By purchasing credits, you agree to Paddle's terms and conditions. All prices are listed in USD and are subject to applicable taxes.

Credits are non-transferable and non-refundable except as described in our Refund Policy.

7. Disclaimers

PromptGen is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the service will be uninterrupted, error-free, or that generated prompts will meet your specific requirements. AI outputs may vary.

8. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service.

9. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date. Continued use of the service after changes constitutes your acceptance of the revised Terms.

10. Governing Law

These Terms are governed by the laws of the Republic of Korea. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts in Korea.
