1. Service Description

PromptGen AI is an AI-powered text analysis tool that analyzes images uploaded by users and generates descriptive text prompts optimized for AI image generation tools such as Midjourney, DALL-E, and similar platforms.

2. Eligibility

You must be at least 14 years of age to use PromptGen AI. By using this service, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent's or guardian's permission to use the service.

3. Accounts and Subscriptions

We offer the following subscription plans:

• Free Plan — 1 image analysis per day, basic features, no payment required.
• Pro Plan — 1,000 credits per month (~100 analyses), suggestion chips, priority processing. Billed monthly.
• Enterprise Plan — 4,000 credits per month (~400 analyses), API access, custom models, team dashboard, priority support. Billed monthly.

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.

4. Acceptable Use

Permitted Uses

• Personal creative projects, artwork analysis, and prompt generation.
• Professional or commercial use of generated prompts in your own projects.
• Integration via API (Enterprise plan) into your own applications.

Prohibited Uses

You agree not to use PromptGen AI to:

• Upload images containing illegal content, including child sexual abuse material (CSAM).
• Upload images of real individuals without their consent for deceptive or harmful purposes.
• Reverse engineer, scrape, or otherwise attempt to extract our AI models or underlying systems.
• Use automated bots or scripts to circumvent usage limits.
• Engage in any activity that violates applicable laws or regulations.
• Resell, sublicense, or redistribute the service without our written consent.

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

5. Intellectual Property

Your Content: You retain all ownership rights to the images you upload. By uploading images, you grant us a limited, temporary license to process them solely for the purpose of generating prompts. Images are deleted immediately after analysis.

Generated Prompts: The text prompts generated by our service based on your images are provided to you for your own use. You may use, modify, copy, and distribute these prompts freely, including for commercial purposes.

Our Technology: The PromptGen AI platform, including its interface, AI models, and underlying technology, remains our exclusive intellectual property. Nothing in these Terms grants you rights to our proprietary technology.

6. Service Availability and Changes

We reserve the right to:

• Modify, suspend, or discontinue the service (or any part thereof) at any time, with or without notice.
• Update these Terms at any time. Continued use of the service after changes constitutes acceptance.
• Adjust pricing or plan features with at least 14 days' notice for existing paid subscribers.

We are not liable for any interruption, delay, or discontinuation of the service.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY GENERATED PROMPTS WILL MEET YOUR EXPECTATIONS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PROMPTGEN AI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 3 MONTHS PRECEDING THE CLAIM.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Korea, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Seoul, South Korea.
